Abstract |
Dans son jugement du 21 avril 2010, le Tribunal administratif fédéral (TAF) a confirmé la pratique de la Régie fédérale des alcools (RFA) en matière de lutte contre les promesses d’avantages pour les boissons spiritueuses («Happy Hours», «Deux pour un», «Ladies Night», etc). Le jugement du TAF établit un cas de précédence. Il s’agit en effet du tout premier arrêt sur des promesses d’avantages de type «Happy Hours». Il confirme l’interdiction édictée par la Loi fédérale sur l’alcool et les principes de son application stricte par la RFA. La RFA se déclare très satisfaite de ce jugement, qui valide son travail et lui offre une base encore plus solide pour lutter efficacement contre les prix d’appel incitant à la consommation immodérée d’alcool. |

Abstract |
Das Bundesverwaltungsgericht (BVGer) hat in seinem Urteil vom 21. April 2010 die Praxis der Eidgenössischen Alkoholverwaltung (EAV) bei der Bekämpfung von Versprechen von Vergünstigungen für Spirituosen (Happy Hours, 2 für 1, Ladies Night, u.ä.) gutgeheissen. Das Urteil des BVGer schafft einen Präzedenzfall. Dieser allererste Bundesverwaltungsgerichtsentscheid zu Versprechen von Vergünstigungen dieser Art bekräftigt das im Bundesgesetz vom 21. Juni 1932 über die gebrannten Wasser (Alkoholgesetz) verankerte Verbot sowie im Grundsatz seine strikte Anwendung durch die EAV. Die EAV ist mit dem Urteil, das eine Anerkennung ihrer bisherigen Bemühungen darstellt, sehr zufrieden. Es verschafft ihr eine solide Grundlage, um die Lockvogelpreise, mit denen zum Alkoholkonsum animiert werden soll, noch wirksamer zu bekämpfen. |

Cette nouvelle association faîtière garantit un effet de synergie entre les deux institutions. La séparation entre substances légales et substances illégales est supprimée. Le rapprochement met en oeuvre un mandat de la Direction de la santé publique et de la prévoyance sociale du canton de Berne. |

Damit wird ein Auftrag der kantonalen Gesundheits- und Fürsorgedirektion umgesetzt. |

Le entrate fiscali come pure il consumo pro capite di bevande spiritose sono rimasti stabili. Con un valore pari al 13 per cento, la quota di mercato di bevande spiritose prodotte all’interno del Paese registra il valore più basso dall’inizio dei rilevamenti statistici. Le avverse condizioni economiche globali sono state avvertite anche nell’ambito dello smercio di etanolo. Nell’ultimo trimestre 2009 è stata tuttavia registrata una chiara ripresa. |

Aussi bien les recettes fiscales que la consommation de spiritueux par habitant sont restées stables. Représentant seulement 13 % de part de marché, les spiritueux fabriqués en Suisse ont atteint leur plus bas niveau depuis l’introduction des statistiques. La situation économique globalement défavorable a également pesé sur les ventes d’éthanol. Au cours du dernier trimestre 2009, on a toutefois noté une nette reprise dans ce domaine. |

Die Steuereinnahmen wie auch der Pro-Kopf-Konsum von Spirituosen sind stabil geblieben. Der Marktanteil der im Inland hergestellten Spirituosen erreichte mit 13 Prozent den tiefsten Wert seit Beginn der statistischen Erfassung. Die widrigen gesamtwirtschaftlichen Umstände waren auch beim Absatz von Ethanol spürbar. Im letzten Quartal 2009 ist in diesem Bereich jedoch ein deutlicher Aufschwung zu verzeichnen. |
